I'm nervously waiting for my final paycheck. I was hoping to have it in my hands by now so I could rush out to desposit it immediately.
What's the story on the whole, "they have to have your final paycheck to you within X days" law? I'm assuming they are just violating laws left and right at this point.

Well, the check came yesterday.
It seems like the last two checks were lower than they should have been.

Got my last paycheck in the mail yesterday. (10/17 terminated) Yes, the firm is in violation of various Cal labor laws. But the penalty for that is (mostly) civil claims for the unpaid wages, and sometimes monetary penalty amounts. In a failed company setting, the question is always whether you can collect those amounts. If you are in California, you have a claim for 'waiting time' between your last day and the day you get your check. Official info on such matters is here: www.dir.ca.gov/dlse/HowToFileWageClaim.htmConsider sending the firm a demand letter for any amounts you are owed (including 'waiting time'). Currently -- I think -- mail is just going into bins on 9, so maybe direct it to the Dissolution Committee care of its chairman (Benvenutti, who is now at Jones Day - SF). (And bless this site for, among other things, having a spell check function.)

I also had a reimbursement check floating around out there. I pretty much gave up on ever seeing the money. I wonder if there's any way to include something like that, or am I just being ridiculous?

The Cal Divison of Labor Standards states, on its web site, that expenses are not included within the protections for non-payment of wages. Doesn't mean that you don't have a claim against the firm for an unpaid expense reimbursement, just that it seems it wouldn't be a part of a DLSE filing or subject to 'waiting time' penalty.

Somebody on ATL said today they got a check for accrued vacation time. Anybody else seen such a check come through??

I ran to the mailbox after reading the post about vacation pay. Nothing. There apparently is no one in charge of the mail on 9. Large bins stuffed with mail sit unattended. I know people are going over there and rummaging through the bins for mail, so if you're waiting for personal items that might have been delivered to Heller, your mail isn't being returned to sender; rather the mail is sitting in those bins.
